These Terms of Use apply to this website, and to each website operated on behalf of FleetPartners Group Limited (ABN 85 131 557 901) (FleetPartners) and its related bodies corporate (we, us or our), and to all applications and portals provided by us (‘Portals’) to:

our customers, to facilitate applications for our products and services, and to manage those products and services;
our originators, introducers, brokers, dealers and other suppliers (Suppliers), to carry out their appointed functions;

(each, a Website).

These Terms of Use constitute an agreement between us and the person who accesses, or has accessed, the Website (you or your),in conjunction with any other written agreement with us regarding our provision of products and services. Nothing in these Terms of Use limits or varies your obligations under any such written agreements.

By accessing or using the Website, you agree to be bound by these Terms of Use, or if you are accessing the Website on behalf of a business (including a company), you are authorised to bind that business to these Terms of Use.

We may make changes to these Terms of Use from time to time. Any changes will be effective immediately. Your use of the Website after any changes constitutes an agreement for you to comply with, and to be bound by, the updated Terms of Use. Accordingly, you should read these Terms of Use from time to time for changes.

Information about our products and services

The Website may contain general information about products and services that we provide. Unless expressly stated otherwise, this information:

Authentication Credentials

If you are an employee of a FleetPartners customer or an authorised representative of a FleetPartners customer or Supplier (Authorised Person), you may be issued access details and codes (Authentication Credentials) so you may log on to a Portal. FleetPartners will be able to identify you and your activities on the Portal. You warrant that all of the information that you provide to us is accurate, up to date and complete, and that you will promptly notify us of any changes to the information supplied.

You must keep your Authentication Credentials confidential and secure from unauthorised use. You must not allow another person to use your Authentication Credentials and you must not use another person’s Authentication Credentials. You must notify us as soon as possible if you become aware that your Authentication Credentials have become known to another person, or if you suspect unauthorised use of your Authentication Credentials.

Use of the Website

You agree that you will not (either yourself or through a third party):

use the Website to post or transmit any information or materials which breach any laws or regulations, infringe the legal rights of any person, are misleading, defamatory, are contrary to any relevant standards or codes or intimidate, harass or offend any person or are reasonably likely to do so;
use the user name or password of any other Website user without the permission of that user, or provide false information or misleading information to us or to any other person via the Website or in respect of your use of the Website;
use any robot, spider or other automatic device or process to process, monitor, copy, or extract any webpages on the Website, or any of the information, content or data contained within or accessible through the Website, without our prior written permission;
use any device, software (including introducing any virus or worm or other malicious code) or process to interfere or attempt to interfere with the proper working of the Website, or any transaction or process being conducted on or through it;
reverse engineer, reverse assemble, decompile, or otherwise attempt to discover source code or other arithmetical formulae or processes in respect of the software underlying the infrastructure and processes associated with the Website;

Where you are using a Portal, you must only use it to give instructions, make requests or agreements, provide information and access information related to our products and services. If you are an Authorised Person, you must only use the Portal while you remain authorised to do so.

If you breach these Terms of Use, or cease to be an employee of a customer or an Authorised Person, your access to the Portal will be terminated. Termination of your access to the Portal will not affect the validity of any instruction given, agreement made or other action taken by you before FleetPartners notifies you of that termination.

Electronic signing and validity

Where the Website enables you to sign a document or otherwise agree to be bound by a document electronically, you agree that:

the document may be signed electronically; and
when the document is signed electronically, the document is valid and effective for all purposes.

Unless we have been notified that your Authentication Credentials have been compromised, a document which has been signed electronically will be valid and effective for all purposes.

To the extent permitted by law, we are not liable in any way or to any person for any loss or damage howsoever caused, which arises directly or indirectly from your electronic signing of documents or any failure to receive an electronically signed document.

Links to third party websites and software

The Website may provide links to access various other websites operated, or information or software provided, by a third party (Third Party Materials).

We do not endorse, warrant, guarantee or accept any liability for the accuracy, copyright compliance, legality, decency or any other aspect of the content of any Third Party Materials. The inclusion of Third Party Materials does not imply any association with the operator or provider of the Third Party Materials.

Unless otherwise indicated, the use of any Third Party Materials are subject to the agreement between you and the relevant operator or provider.

Governing law

If you access a Website with a .com or a .com.au domain name, the Terms of Use are governed by the law in force in New South Wales, Australia. If you access a Website with a .co.nz domain name, the Terms of Use are governed by the law in force in New Zealand.

Each party submits to the non-exclusive jurisdiction of the courts exercising jurisdiction in New South Wales or New Zealand (as the case may be).

Security of information

When you use the Novated Lease Calculator available on a Website, we allocate a cookie to collect, store (on your computer only) and reuse the personal information that you input in the calculator (including your name, email, phone number and post code). We use this cookie to auto populate the Novated Lease Calculator with your information the next time you use it.

Third Party Cookies

As you browse the Website, cookies will be placed on your computer by our display advertising and content partners so that we can understand what you are interested in. Our partners then enable us to present you with targeted advertising on other sites based on your previous interactions with the Website. The techniques our partners employ do not collect personal information such as your name, email address, postal address or telephone number.
